If any part or provision of these Terms is found to be unenforceable, this shall not affect the validity of any other part or provision.

You may not assign, sub-license, or otherwise transfer any of your rights under these Terms. We may assign these Terms or any rights hereunder without your consent or notice.

These Terms supersede any previous versions.

These Terms shall be governed by English law, and you agree that any dispute between us regarding them or the Site will only be dealt with by the English courts, provided that, if you are a consumer and not a business user and live in a part of the United Kingdom other than England, the applicable law of that part of the United Kingdom will govern and any dispute will only be dealt with by the courts there. For customers in Australia, these Terms shall be governed by the laws of Australia and the parties submit to the non-exclusive jurisdiction of the courts of Australia. For customers in the United States whose contracting entity is Mocavo Inc., these Terms and any dispute arising out of or relating to them or the Site will be governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules, subject to any mandatory consumer-protection rights under applicable federal law or the law of the state in which you reside. Nothing shall prevent us from bringing proceedings to protect our intellectual property rights before any competent court.

To the fullest extent permitted by applicable law, any dispute must be brought only in the parties' individual capacities and not as a plaintiff or class member in any purported class, collective, representative or consolidated action. This waiver applies only to the extent enforceable under the law applicable to the dispute and does not limit any non-waivable consumer right.

U.S. auto-renewal compliance. For customers in the United States, subscription offers and renewals will include the clear and conspicuous disclosures, affirmative consent, reminder notices and cancellation methods described in Sections 4 and 16, and will be administered in accordance with the FTC Negative Option Rule and applicable federal and state automatic-renewal laws.

Nothing in these Terms restricts or limits any rights you may have under the consumer‑protection laws of your country or province of residence (including, without limitation, the US Federal and State laws, the EU Consumer Rights Directive, and the Australian Consumer Law).

For customers in the United States, we will comply with the Federal Trade Commission's Negative Option Rule (16 C.F.R. Part 425) and any applicable state automatic-renewal or continuous-service laws in connection with the offer, sale, and renewal of Subscriptions.
